These Terms & Conditions govern your access to and use of the SwissCRM website and platform. By using our services you agree to these terms.

1. Agreement to terms

These Terms & Conditions ("Terms") form a binding agreement between you and SwissCRM ("SwissCRM", "we", "us"). If you do not agree with any part of these Terms, do not use our website or services.

2. Use of the service

SwissCRM provides a commerce platform for attribution, payment processing, subscription management, fulfillment, and related merchant services. You agree to use the platform only for lawful business purposes and in compliance with all applicable laws, card-network rules, and processor requirements.

3. Accounts

Access to certain features requires an account. You must provide accurate information and promptly update it. You are responsible for all activity under your account.

4. Payments and processing

Where SwissCRM facilitates payment processing, transactions are subject to the terms of the applicable acquiring bank, gateway, and card networks. You are responsible for chargebacks, refunds, and compliance obligations arising from your transactions.

Any payment processing provided by SwissCRM is governed by the Merchant Processing Agreement ("MPA") and its associated agreements. In the event of any conflict between these Terms and the MPA with respect to payment processing, the MPA and its associated agreements shall control.

5. Intellectual property

The SwissCRM platform, website, and all associated content, trademarks, and software are owned by SwissCRM or its licensors and are protected by intellectual-property laws. No rights are granted except as expressly set out in these Terms.

6. Confidentiality & data

Our handling of personal data is described in our Privacy Policy. As a PCI Level 1 Service Provider, we maintain administrative, technical, and physical safeguards appropriate to the services provided.

7. Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, SwissCRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the services.

9. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the services constitutes acceptance of the revised Terms.
